In these terms, "we", "us" and "our" refer to LN E Commerce UG (haftungsbeschränkt) operating netfjk.com. "You" refers to anyone visiting the website or placing an order.

2. SCOPE OF THESE TERMS

These terms apply to every use of netfjk.com and to every order placed through it. The version of these terms that is published on the website at the time of your order applies to that order. Different or conflicting terms of a customer are not accepted unless we have expressly agreed to them in writing.

We may update these terms from time to time, for example when the law changes or when we change our services. Updates apply to future orders only. We recommend that you save or print a copy of these terms for your records.

3. ELIGIBILITY

Our shop is directed at customers with a delivery address in Germany. To place an order you must be at least 18 years old and legally able to enter into a binding contract. We only sell in quantities that are usual for private households.

4. USE OF THE WEBSITE

You may use netfjk.com for lawful purposes only. When using the website you agree not to:

Interfere with the security or functioning of the website, its servers or connected networks.

Upload or transmit viruses or any other harmful code.

Copy, scrape or collect content or personal data from the website by automated means.

Try to gain access to areas of the website that are not open to the public.

Use a false identity or provide misleading information.

Post content that is unlawful, offensive, defamatory or that infringes the rights of others.

We may restrict or suspend access to the website if we have good reason to believe these rules are being broken.

5. INTELLECTUAL PROPERTY

All content on netfjk.com, including texts, product descriptions, photos, graphics, logos and the design of the website, is owned by us or used with permission and is protected by copyright and other laws. You may view and print pages for your own personal use, for example to keep a record of your order. Any other copying, editing, distribution or commercial use requires our prior written consent.

6. PRODUCTS AND PRICES

We take care to describe and photograph our products as accurately as possible. Small differences in colour, texture or size may occur, especially with natural materials such as wood or woven fibres, and because screens display colours differently. Such natural variations are part of the character of these products and are not considered a defect.

All prices are stated in euro and include the statutory German value added tax. Shipping costs are shown separately before you complete your order. We reserve the right to change prices and our product range at any time, but the price shown at the moment you place your order is the price you pay.

If a clearly obvious pricing error occurs, we will contact you before processing your order and you may decide whether to proceed at the correct price or cancel. Any amount already paid will be refunded in full if you cancel.

7. ORDERS AND CONCLUSION OF CONTRACT

The products shown on our website are not a binding offer but an invitation for you to place an order. By clicking the order button at the end of the checkout, you submit a binding offer to buy the products in your shopping cart.

Before submitting your order you can review all details and correct any input errors. Shortly after your order, you will receive an automatic email confirming that we have received it. This confirmation does not yet mean your order has been accepted. A contract is formed when we send you a separate order confirmation or shipping confirmation, or when we dispatch the goods, whichever comes first.

If a product turns out to be unavailable, we will let you know as soon as possible and refund any payment already made without delay.

The contract language is English. We store the contract text after your order, and you will receive the order details by email.

8. PAYMENT

Payment can be made using the methods offered at checkout. By placing an order you confirm that you are authorised to use the payment method you have chosen and that the information you provide is correct and complete. We may cancel an order if there are reasonable grounds to suspect fraudulent or incorrect payment details.

The goods remain our property until they have been paid for in full.

9. SHIPPING AND DELIVERY

We ship exclusively within Germany, and all orders are sent from Germany. We currently offer two shipping options:

Standard Shipping: free of charge, with an estimated delivery time of 4 to 5 business days.

Insured Express Shipping: 4.95 EUR, with an estimated delivery time of 2 to 3 business days. Your parcel is insured during transport.

Delivery times begin the day after your order has been placed and payment has been confirmed. Business days are Monday to Friday, excluding public holidays. The stated delivery times are estimates, and in rare cases delays can occur due to high order volumes or circumstances at the shipping carrier.

Please make sure your delivery address is complete and correct. If a parcel is returned to us because of an incorrect address or because it was not collected, we will contact you to arrange a new delivery.

If your order is delayed significantly, we will inform you as soon as possible. If delivery is no longer possible or you no longer wish to wait, you may cancel the order and we will refund the full amount paid.

The risk of accidental loss or damage passes to you when the goods are handed to you or to a person you have authorised to receive them.

10. RIGHT OF WITHDRAWAL

If you are a consumer, you have the following statutory right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods. If you have ordered several goods as part of one order and they are delivered separately, the period starts on the day on which you or your named third party take possession of the last item.

You may use the model withdrawal form below, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notice of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal. This means that the 4.95 EUR surcharge for Insured Express Shipping is not refunded. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have sent them back, whichever is earlier.

You must return the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss results from handling them in a way that is not necessary to check their nature, characteristics and functioning.

11. DAMAGED, FAULTY OR INCORRECT ITEMS

Statutory warranty rights apply to all products purchased from netfjk.com. If an item arrives damaged, faulty or is not the item you ordered, please contact us at support@netfjk.com, ideally within seven days of receipt, and include your order number and a few photos of the problem. This helps us resolve the matter quickly and make a claim with the carrier if needed. Contacting us later does not affect your statutory warranty rights.

In such cases we will offer you a replacement or a refund and will cover the costs of sending the item back to us.

12. REVIEWS AND CONTENT YOU SUBMIT

If you send us reviews, photos or comments, you confirm that you own the rights to this content, that it is truthful, and that it does not infringe the rights of anyone else. You allow us to use, display and publish this content on our website and in our communications free of charge. We may decide not to publish content or to remove it, especially if it breaks the rules in section 4.

13. LINKS TO OTHER WEBSITES

Our website may contain links to websites of third parties. We have no control over these websites and are not responsible for their content. Visiting them is at your own discretion, and their own terms and privacy policies apply.

14. LIABILITY

We are fully liable for damages caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations, meaning obligations whose fulfilment is necessary for the proper performance of the contract and on which you may regularly rely. In such cases our liability is limited to the typical damage that was foreseeable at the time the contract was concluded.

Beyond this, our liability is excluded. These limitations also apply to our employees and agents.

We aim to keep the website available and free of errors, but we cannot guarantee that it will always be available without interruption.

15. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures in fulfilling our obligations that are caused by events outside our reasonable control, such as strikes, severe weather, disruptions at shipping carriers or official measures. In such cases we will inform you as soon as possible, and you may cancel an affected order and receive a full refund.

16. PRIVACY

We take the protection of your personal data seriously. Information on how we collect, use and protect your data can be found in our Privacy Policy on netfjk.com.

17. DISPUTE RESOLUTION

If you are unhappy with your order or our service, please contact us first at support@netfjk.com. We will do our best to find a fair solution together with you.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

18. GOVERNING LAW

These terms and all contracts concluded through netfjk.com are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not remove the protection you enjoy under the mandatory consumer protection laws of the country where you normally live.

If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contracts with us is our registered office in Spenge.

19. FINAL PROVISIONS

If any provision of these terms is or becomes invalid, the remaining provisions remain in effect. If we do not enforce one of our rights right away, this does not mean we have waived it.
